Are Your Workplace Posters Up-to-Date?

 

Just when you thought you were completely in compliance with all the posting regulations, the US Department of Labor has issued two revised federal posters now required as of August 1, 2016.

The Fair Labor Standards Act (FLSA) poster has been updated to include the requirement for employers to provide reasonable break time for nursing mothers for up to one year after the birth of their child and a private workplace location to accommodate these breaks other than a restroom. There is also a section advising workers of independent contractor misclassification. The poster explains the difference between an employee and an independent contractor. Information regarding a “tip credit” for employers is also included. Employers may claim a partial wage credit based on the tips received by employees, as long as those tipped employees meet specific requirements. A QR code has been added to assist with compliance and instructions for workers on how to file a complaint.

The revision to the Employee Polygraph Protection Act (EPPA) poster eliminated reference to the amount of penalty to which employers could be subjected and places a QR code for agency contact information.
